Terms: a 2.5% buyers premium will be added to the high bid price to arrive at total sale price. The successful buyers will pay a non-refundable deposit of $10,000 for Tract #1 and $7,500 for Tract #2.

The tracts will be sold individually and not recombined.
A non-refundable deposit of $10,000 for Tract #1 and $7,500 for Tract #2 is due on the day of auction when the successful bidder will execute a standard real estate contract.
Buyers shall provide a bank letter of credit in the amount of the deposit or through prior arrangements suitable to sellers and auctioneers. The remainder of the purchase price is due at closing on or about October 15th, 2021.
Sellers will pay transfer tax and provide a clear marketable title at closing. Real Estate taxes will be prorated to the date of closing.

In the Agricultural district;
Density standard is: one dwelling per quarter section. There are two other dwellings already located in the NW quarter of section 13, the house on this property is the third. For someone interested in building on this parcel, that’s important – a person has a right to build (re-build) if there is already a home on the property with a couple of caveats: 1) there can only be one dwelling per parcel, ie the other house has to come down, 2) the new house has to be permitted for construction (ie. zoning permit obtained) within 12 months of the old one being torn down or the right to re-establish is lost, and 3) the owner needs to have a licensed septic professional establish where the primary and secondary septic system sites will be in order to demonstrate the lot is sustainable for residential use.
Setbacks are: for structures to be constructed – 40 feet from front yard, 20 feet from side and rear yards. Setbacks are also described in the Ag Zoning section. **Please note**: compliance inspections are required at the time of transfer of property, ie. at closing. Without a compliance inspection, an escrow account is required to cover the cost of a new system. A person can forego an inspection if they are willing to call the system failing, which will place it on a 10-month schedule to abandon or replace.
Land uses:
Permitted or Allowed uses include: agricultural use, conservation areas, home occupation business, and dwellings. Other uses are “conditional”, meaning they require a Conditional Use Permit, such as commercial recreation, horse stables, campgrounds, alcohol stills, mini storage, mining, etc.

Feedlots are an allowed use the Agricultural district, however, they have to be located 1000 feet from any residence (except the owners), so – the proximity of the residence across the road to the west basically restricts this parcel from obtaining a feedlot permit. A person can keep horses, a few cattle, “hobby farm” animals, so long as there is less than 10 animal units and no open lots are established (where vegetation cannot be maintained). Specific rules regarding Feedlots are in the ordinance on page 42 (section 14-18.2).
